These Terms of Use (hereinafter "Terms") define the terms and conditions under which SealTrust SAS (hereinafter "SealTrust") provides its product authentication platform (hereinafter "the Service") and the conditions under which users (hereinafter "the User") may access and use the Service. Access to and use of the Service are subject to acceptance of and compliance with these Terms. By accessing or using the Service, the User acknowledges having read and accepts these Terms without reservation.
The Service is accessible at https://sealtrust.io and through associated mobile applications. SealTrust endeavors to maintain the Service available 24 hours a day, 7 days a week, but is not bound by any obligation of result. Access to the Service may be interrupted for maintenance, updates, or force majeure. SealTrust shall not be held liable for damages of any kind resulting from the unavailability of the Service. The User is responsible for ensuring the compatibility of their equipment and internet connection with the Service.
The use of certain features of the Service requires creating a user account. The User agrees to provide accurate, complete, and up-to-date information during registration and to keep this information current. The User is solely responsible for the confidentiality of their login credentials and for any use made of their account. In the event of unauthorized use of their account, the User must inform SealTrust immediately. SealTrust reserves the right to suspend or delete an account in the event of a breach of these Terms, without prior notice or compensation.
All elements of the Service (text, graphics, software, images, videos, sounds, databases, names, logos, trademarks) are protected by intellectual property laws. These elements are the exclusive property of SealTrust or its partners. Any reproduction, representation, modification, distribution, or exploitation of all or part of the Service, by any means, without the prior written authorization of SealTrust, is strictly prohibited and constitutes an act of infringement punishable under intellectual property law. Authenticity certificates generated by the Service (NFTs) remain the property of the User or the holder of the authenticated product.
SealTrust uses all reasonable means to ensure the reliability of its authentication Service. However, SealTrust cannot guarantee the absolute accuracy of verification results and shall not be held liable for authentication errors. SealTrust shall not be held liable for direct or indirect damages caused to the User or third parties resulting from the use or inability to use the Service. SealTrust's liability is in any event limited to the amounts actually paid by the User during the preceding 12 months. SealTrust disclaims all liability regarding blockchain transactions, which are irreversible by nature.
SealTrust collects and processes personal data as part of providing the Service, in accordance with the General Data Protection Regulation (GDPR) and French data protection legislation. The procedures for collecting, processing, and storing personal data are described in our Privacy Policy, accessible from the dedicated page. The User has the right to access, rectify, erase, port, and object to the processing of their personal data. SealTrust reserves the right to modify these Terms at any time. Modifications shall take effect upon publication on the Service. The User will be informed of material changes by appropriate means (in-app notification, email). Continued use of the Service after the publication of modified Terms constitutes acceptance of the new conditions. In the event of disagreement with the new Terms, the User must stop using the Service and may request deletion of their account.
These Terms are governed by French law. In the event of a dispute relating to the interpretation or performance of these Terms, the parties agree to seek an amicable resolution. Failing an amicable agreement within 30 days, any dispute shall be subject to the exclusive jurisdiction of the courts of Lyon, except where mandatory legal provisions provide otherwise. In accordance with consumer protection legislation, the User is informed that they may use a consumer mediator under the conditions set out in Articles L.611-1 et seq. of the French Consumer Code.
